LONDON — The Supreme Court of the United Kingdom on Friday said it will hear a case that could lead to a ban on the sale of prescription drugs.
The High Court ruled that the European Medicines Agency (EMA) had no obligation to prescribe drugs containing the active pharmaceutical ingredient sildenafil citrate.
The EMA argued that it was not required to do so under the Food and Drugs Act (FDA) because the drug is approved for sale only under a prescription.
The EMA said the decision, which was based in part on the European Medicines Agency’s decision to allow “Viagra” to be sold without a prescription. However, it said that the decision did not make it clear what the drug is, and the European Medicines Agency could therefore change its stance.
The FDA had previously ruled that sildenafil, sold under the brand name Revatio, is safe and effective in the treatment of erectile dysfunction.
